Your missions as a Regulatory Counsel at Spiko
You will report to the Head of Legal & Compliance. Your main missions will be:
License applications (MiFID and MiCA): you will lead license applications processes, which may include extensions of our existing MiFID investment firm license or a free-standing MiCA license. You will be the main point of contact of regulators and external counsel, and ensure that these processes are conducted efficiently.
Crossborder distribution in the EU/EEA: you will handle our passporting notifications and act as the point of contact of the regulatory authorities of the host countries. You will ensure the legal compliance of our activities in the countries where we are passported, in relation with local external counsel if needed.
Regulatory compliance: in partnership with the Compliance team, you will handle various aspects of the regulatory compliance of our activities. This will include drafting/updating operational procedures, maintaining registers, auditing counterparties, and filing regulatory reports.
Miscellaneous: you will support the Head of Legal in various non-recurring matters, such as new products/services analysis, updates of the legal documentation, corporate law, litigation, non-core commercial agreements, etc.
Ideal profile
Required:
Academic background: you graduated from a law university or a business school, ideally with a degree in banking and financial law.
Experience: you have at least 4 years of experience in the legal department of a fintech or a banking/financial institution or the financial regulation department of a law firm.
Engaging with regulators: you have a proven track record of engaging with French (and/or other EU) financial regulators in relation to license applications.
Knowledge of financial regulation: the applicant should have an expert knowledge of the main regulatory frameworks that are relevant to Spiko (i.e. MiFID/MiFIR, MiCA, and the anti-money laundering regulation).
Versatility: as one of the first members of our legal team, your role will involve the management of legal/regulatory compliance across several jurisdictions (e.g. in the context of our EU/EEA crossborder distribution) and several regulatory frameworks.
Mindset: you’re highly ambitious and eager to be one of the first members of a team striving for excellence
Excellent communication skills: Fluent in French (native level) with excellent written skills, and professionally proficient in English.
Nice to have:
Experience with UCITS/AIFMD and the PRIIPS framework is a plus.
Experience with DORA and GDPR is also nice to have.
Experience in a fast growing fintech start-up environment.
